What Information Is Confidential?
When you undergo rehabilitation, various types of information are considered confidential:
- Personal Information: This includes your identity, contact details and any information related to your medical history or treatment.
- Medical Records: Details of your diagnosis, treatment plans, progress notes and any other medical information are strictly confidential.
- Therapy Sessions: Conversations with therapists, counselors or support groups are confidential. This confidentiality encourages open and honest communication, essential for effective therapy.
- Drug Test Results: Results of drug tests conducted as part of your treatment are confidential medical information.
Who Has Access to My Drug Rehab Information?
Access to your confidential information is limited to authorized individuals involved in your treatment. This typically includes:
- Healthcare Providers: This encompasses doctors, nurses, therapists, counselors and other medical staff directly involved in your care.
- Administrative Staff: Personnel responsible for managing your records within the healthcare facility also have access to your information. However, they are bound by the same confidentiality rules as healthcare providers.
- Insurance Companies: In some cases, insurance companies may require access to certain information for billing purposes. However, they are also bound by privacy regulations and can only access information necessary for processing claims.
Will Rehab Be on My Record?
The answer to whether rehab will be on your record depends on the context:
- Medical Records: Information about your rehabilitation treatment will be included in your medical records. However, access to these records is restricted to authorized individuals, and they cannot be disclosed without your consent, except in specific circumstances permitted by law (e.g., court order or medical emergency).
- Background Checks: Will my rehab treatment show up on a background check? If you undergo a background check for employment, education or other purposes, your rehabilitation history generally will not be disclosed unless you provide consent. However, certain industries, such as healthcare, law enforcement or the military may have specific regulations regarding disclosure of substance abuse treatment.
- Legal Records: If you are involved in legal proceedings where your rehabilitation history is relevant, such as a custody battle or criminal case, the court may request access to relevant information. In such cases, the court will typically take measures to protect your privacy to the extent possible.
Will Rehab Show on My Military Record?
Many active duty service members wonder about how much information their health team and commands will receive about their mental health and substance abuse treatment.
In our program at Salt Lake Behavioral Health, the command of the person is only told projected length of stay in order to book travel and coordinate orders for the member. No other protected health information is disclosed to command unless the person is discharging with a required safety escort (meaning that the person has active suicidal ideation), in which case the command will be asked to provide an escort because the patient is a danger to themselves. In such cases, usually the patient will be discharged to a lower level of care.
As far as the referring military mental health professional, all information including diagnoses, medications and medical records are shared back with the health provider that referred the patient to our care.
